1. Definitions

Throughout these Terms, the following terms carry the meanings given below:

• "Keystay" / "we" / "us" — Keystay, operating from 33 Kata Road, Karon, Mueang Phuket, Phuket 83100, Thailand.
• "User" / "you" — any individual who accesses our website or engages our services.
• "Services" — furnished short-stay rentals, long-term rental guidance, and the Resident Care Package, as described on this website.
• "Agreement" — the contract formed when you engage our services and confirm acceptance of these Terms.
• "Property" — any residential unit presented by Keystay in connection with a rental arrangement.

2. Acceptance of Terms

By contacting Keystay with a service request, submitting a contact form, or engaging any of our services, you confirm that you have read, understood, and agreed to these Terms. Our services are available to individuals aged 18 years and over with the legal capacity to enter a binding agreement.

3. Service Description

Keystay provides property rental facilitation services in the Kata and Karon areas of Phuket, Thailand. Our three core services are described in full on the Solutions page of this website. Service availability is subject to property availability, seasonal conditions, and individual circumstances. We do not guarantee that specific properties will be available at any given time.

4. User Responsibilities

When using our services, you agree to:

• Provide accurate and complete information during the consultation process
• Communicate any relevant changes to your requirements or circumstances promptly
• Review all documents presented to you carefully and ask questions if anything is unclear
• Comply with the terms of any rental or lease agreement entered into with a landlord
• Treat Keystay staff and third-party contacts with professionalism and courtesy

5. Service Fees and Payment

Service fees are as published on this website and are denominated in Thai Baht (THB). Fees are confirmed in writing before any service engagement is formalised. Payment terms will be communicated clearly at the time of confirmation.

Keystay does not accept commissions from landlords in connection with the services described. Our fees are paid by the client and represent the total cost of the service outlined.

The Resident Care Package is billed monthly. Cancellation requires 30 days' written notice. No partial refunds are issued for months already billed and commenced.

6. Rental Guidance Service — Specific Terms

The Thorough Rental Guidance service fee covers the search, shortlisting, viewing coordination, lease review, and move-in support process as described. The fee becomes payable once the service engagement is confirmed. In the event that no suitable property is found within 60 days of commencement for reasons within our control, a partial refund may be discussed at our discretion.

Keystay is not party to any lease agreement between the client and a landlord. We act as an adviser and facilitator only. Any tenancy agreement is a direct contract between the client and the landlord.

7. Intellectual Property

All content on this website, including text, design, and structure, is the intellectual property of Keystay. You may not reproduce, distribute, or commercially exploit any content without written permission. A limited, non-exclusive licence is granted for personal use of the website.

8. Disclaimers

Keystay provides services in good faith and with due care. However, we make no warranties that any property will meet your specific expectations beyond what is documented and agreed. Property conditions, landlord responsiveness, and external factors (such as infrastructure or local services) are beyond our direct control.

The information provided on our website is for general guidance only and does not constitute legal or financial advice.

9. Limitation of Liability

To the extent permitted by Thai law, Keystay's liability for any claim arising from a service engagement is limited to the fee paid for that specific service. We are not liable for indirect, consequential, or incidental losses, including loss of income, rental disputes with landlords, or property damage not arising from Keystay's own negligence.

10. Indemnification

You agree to indemnify Keystay against any claims, damages, or costs arising from your misuse of our services, breach of these Terms, or any agreement entered into with a third party (including a landlord) as a result of our services.

11. Termination

Either party may terminate a service engagement by written notice. Keystay reserves the right to discontinue services if a client engages in conduct that is harmful, misleading, or in breach of these Terms. In such cases, fees already paid may be retained at our discretion.

12. Dispute Resolution

These Terms are governed by the laws of Thailand. In the event of a dispute, both parties agree to first attempt resolution through direct communication. If unresolved, disputes may be referred to mediation before any formal legal proceedings are initiated. Jurisdiction lies with the courts of Phuket Province, Thailand.

13. Changes to These Terms

We may update these Terms from time to time. Significant changes will be noted on our website with an updated effective date. Continued use of our services after any change constitutes acceptance of the revised Terms.
